1. Acceptance of Terms

By accessing or using Radhiant Life ("the Service"), operated by Radhiant Foundation ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Radhiant Life is a health and wellness platform designed for executives and high-performance professionals. The Service provides health data aggregation from wearable devices, AI-powered coaching, energy management tools, fatigue tracking, weekly energy audits, and personalized health insights. The Service integrates with third-party wearable devices and health platforms including, but not limited to, Whoop, Oura, Garmin, Suunto, Apple HealthKit, and Android Health Connect.

To use the Service, you must create an account using our authentication system. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account if we reasonably believe that your account has been compromised or if you have violated these Terms.

5. Health Data and Wearable Integrations

By connecting wearable devices and health platforms to the Service, you authorize us to access, collect, and process your health data as described in our Privacy Policy. You acknowledge that:

• The accuracy of health data depends on the connected devices and their manufacturers.
• We are not responsible for inaccuracies in data provided by third-party devices or platforms.
• You may disconnect any wearable device at any time through the Settings page.
• Disconnecting a device does not automatically delete previously collected data; you may request data deletion separately.
• We use OAuth-based authentication for all wearable connections and never store your device passwords.

6. AI-Powered Features

The Service uses artificial intelligence to provide health insights, coaching recommendations, energy audits, and anomaly detection. You acknowledge that:

• AI-generated insights are based on patterns in your data and general health research, not personalized medical assessment.
• AI recommendations may not be appropriate for individuals with specific medical conditions.
• The AI system continuously improves but may occasionally provide inaccurate or incomplete insights.
• You should use your own judgment and consult healthcare professionals before making significant health decisions based on AI recommendations.

7. Subscription and Payments

Certain features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. Subscriptions automatically renew unless cancelled before the renewal date. Payments are processed through Stripe, and you agree to Stripe's terms of service for payment processing. We reserve the right to change subscription prices with 30 days' notice. Refunds are handled in accordance with our refund policy, which may vary by jurisdiction.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Use automated means (bots, scrapers) to access the Service without our written consent.
• Share your account credentials with third parties or allow others to access your account.
• Upload or transmit malicious code, viruses, or other harmful content.
• Use the Service to collect or store personal data about other users without their consent.

9. Intellectual Property

The Service, including its original content, features, functionality, design, and branding, is owned by Radhiant Foundation and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of your personal health data. By using the Service, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing the Service to you.

10. Data Portability

You have the right to export your data at any time using the data export feature within the Service. Exported data will be provided in standard formats (CSV, JSON, or PDF) as applicable. We support your right to data portability as required by applicable data protection laws including GDPR, POPIA, and CCPA.

The Service integrates with third-party services including wearable device platforms, calendar providers, and payment processors. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services. We do not guarantee the continued availability of any third-party integration.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Radhiant Foundation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service. In particular, we shall not be liable for any health outcomes, medical decisions, or personal injury resulting from reliance on information provided by the Service.

13. Indemnification

You agree to defend, indemnify, and hold harmless Radhiant Foundation and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will endeavor to provide advance notice of planned maintenance where possible.

15. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may request deletion of your data upon account termination, subject to any legal retention requirements.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
